Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") are an agreement between you and Calaway Solutions ("CurriBloom", "we", "us") governing your use of the CurriBloom website and applications (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Child & Student Privacy Notice. If you do not agree, do not use the Service.

2. Who may use CurriBloom

You must be at least 18 years old and an adult parent, guardian, or educator responsible for the students you add. Children do not have accounts and may not use the Service. You are responsible for everything that happens under your account and household.

3. What CurriBloom is — and is not

CurriBloom is an organizational and record-keeping tool that helps you plan learning and keep education records. It is not a school, curriculum provider, accreditation body, or legal-compliance service.

You are solely responsible for meeting the homeschooling, attendance, testing, reporting, and record-keeping requirements that apply where you live. CurriBloom does not provide legal, educational, or compliance advice, and using it does not guarantee that you satisfy any legal requirement.

4. Your account and security

Provide accurate account information and keep your password secure. Do not share your credentials. Notify us promptly of any unauthorized use. We may require you to re-authenticate for sensitive actions such as changing credentials, exporting everything, or deleting your account.

5. Your content

You own the content you create in CurriBloom — your students, curriculum, records, notes, and uploaded files ("Your Content"). You grant us a limited license to host, store, process, and display Your Content solely to operate and provide the Service to you (for example, to store a file and show it back to you, or to generate an export you request).

You are responsible for Your Content and for having the right to add it, including the right to enter information about the students in your household. You must not upload content you do not have the right to use.

6. Acceptable use

You agree not to:

• Use the Service for anything unlawful, harmful, or infringing, or to store or share content you have no right to.
• Upload malware, or attempt to breach, probe, overload, or disrupt the Service or its security or tenant isolation.
• Access another household’s data, guess identifiers, or misuse share links.
• Reverse engineer, scrape, or build a competing service from the Service, except where such restriction is prohibited by law.
• Exceed documented limits (for example, file type, per-file size, and storage quotas) or circumvent access controls.

We may remove content or suspend accounts that violate these Terms or put others at risk.

7. Plans, pricing, and payment

CurriBloom offers a free plan and paid subscriptions (currently Family and Family+, billed monthly or annually). Current plans and prices are shown on our website and may change; we will give reasonable notice of price changes that affect you.

Payments are processed by Stripe, our payment provider. When you subscribe, you enter your card details directly on Stripe’s secure pages, and your use of Stripe’s checkout and billing portal is also subject to Stripe’s terms. Your card information is handled by Stripe; we do not receive or store your full card number.

Paid subscriptions renew automatically for the stated period (monthly or annually) until you cancel. If a plan includes a free trial, it converts to a paid subscription when the trial ends unless you cancel before then. You can cancel or change your plan at any time from the billing portal (Settings → Manage subscription); cancellation takes effect at the end of the current billing period, and you keep access until then.

Except where required by law or expressly stated, payments and subscription fees are non-refundable. You are responsible for any applicable taxes. If a paid plan is canceled or lapses, your household continues on the free plan, and your records remain subject to the free plan’s limits.

8. Privacy

Our Privacy Policy and Child & Student Privacy Notice explain how we handle your information and your children’s information. By using the Service you agree to those documents.

9. Availability and changes to the Service

We work to keep CurriBloom available and reliable, but we may modify, suspend, or discontinue features, and the Service may occasionally be unavailable. We will try to give notice of significant changes and to preserve your ability to export your data.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet any legal or educational requirement that applies to you.

11. Limitation of liability

To the fullest extent permitted by law, CurriBloom and Calaway Solutions will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or fifty U.S. dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

You are responsible for keeping your own copies of important records; you can request an export of your records for this purpose (see the Export instructions).

12. Indemnification

You agree to indemnify and hold harmless CurriBloom and Calaway Solutions from claims arising out of your content, your use of the Service, or your violation of these Terms or of any law or third-party right.

13. Termination

You may stop using the Service and delete your account and household at any time. We may suspend or terminate access if you materially violate these Terms or create risk for others. On account deletion, we remove your data through our controlled deletion workflow, except where limited retention is legally required.

14. Governing law and disputes

These Terms are governed by the laws of the United States and of the state in which Calaway Solutions is established, without regard to conflict-of-laws principles. You agree that the state and federal courts located there have jurisdiction over disputes not otherwise resolved, except where applicable law grants you the right to bring a claim elsewhere. Before filing, we encourage you to contact us so we can try to resolve the matter.

15. Changes to these Terms

We may update these Terms as the Service evolves or the law requires. Material changes update the effective date above and, where appropriate, are brought to your attention. Continuing to use the Service after an update means you accept the revised Terms.
